Terms

Payment is required in advance, or within 30 days from invoice for approved credit holders.  Credit facilities on any account may be withdrawn or varied at the discretion of Eurocentric Wine Imports without notice to the purchaser. EWI reserves the right to charge interest at 1.5% per month on all monies owing outside agreed trading terms by the purchaser and, further, the purchaser agrees to reimburse EWI for any legal expenses, collection expenses or bank charges incurred by EWI in the recovery or attempted recovery of overdue monies. The placement of an order constitutes the acceptance of these terms.

Retention of Title

All goods delivered by EWI remain the property of EWI and the title of any goods does not pass to the purchaser until all debts owed to EWI on any account, including interest, bank charges, legal fees and collection expenses are paid to EWI in full. In this regard the purchaser grants the right to EWI to enter the purchasers premises, or any other premises where the goods are reasonably believed to be stored, without notice, to take possession of the goods. Not withstanding the foregoing, it is agreed that the goods are at the entire risk of the purchaser from the time of delivery.

Claims Procedure

Any claims of whatever nature must be reported to EWI within seven days of receipt of goods or the purchaser is deemed to forfeit any claims for damages or replacement against EWI. Please quote invoice number, account name, delivery address and date, as well as all other relevant details pertaining to your claim.

Claims Liability

Subject only to the provisions of the Trade Practices Act which necessarily apply to the contract and cannot be excluded, all other implied terms, conditions and warranties are hereby expressly excluded and EWI’s liability is limited to the cost of replacing the goods or the cost of obtaining equivalent goods; whichever is the lower amount.

EWI will accept faulty stock (including label damage, dry breaks, leakers or short fills etc.) for replacement only if seals on bottles are intact and the agreed time period has not expired. Damaged stock found after delivery must be returned in the original carton for replacement. Restaurant returns are acceptable only if the product is delivered out of condition or otherwise proven to be defective because of seal failure.

In all cases, stock must be viewed and returned through an approved EWI agent. Supply invoice number and delivery date must be provided in order to action replacement or credit. No replacement or credit will be forthcoming on stock broken or damaged on the purchaser’s premises.

Pallet Exchange

The purchaser agrees to exchange EWI pallets that accompany the goods purchased, with pallets of a similar brand and condition. In the event that the purchaser is unable to exchange said pallets, the purchaser will be charged for the cost of the pallets at EWI’s replacement cost.
